This Privacy Policy describes VSB Opco, LLC’s (“Popchips”, “we”, or “us”) practices regarding the collection, use, storage, sharing, and safeguarding of your information collected from any Popchips-operated website, mobile application, or other service (collectively, the “Service”).

Changes to this Privacy Policy

Popchips may make changes to this Privacy Policy. The most current version of the Privacy Policy will govern Popchips’ use of information about you and will be located at www.popchips.com/privacy-policy. If Popchips makes material changes to this Privacy Policy, Popchips will notify you by posting a notice on the Service and sending notices to the contact information Popchips has on file for you. Please ensure this information remains current so you will receive updates.

Categories of Personally Identifiable Information that Popchips Collects

Popchips may collect information that you provide to Popchips in connection with your use of the Service when you: (A) send messages, forms, or other information to Popchips or its service providers through the Service; (B) sign up to receive information or promotions from Popchips; or (C) otherwise interact with the Service. This information may include your first and last name, your address, email address, telephone number, and any additional information you provide to Popchips via the Service.

Popchips may also collect certain technical information about your use of the Service. This technical information may include technical information about your device(s), browser type and version, geo-location information, computer and connection information, statistics on page views, traffic to and from the Service, ad data, Wi-Fi connection information, IP address, and standard web log information.

We use a third-party payment processor to process your orders on the Service. Our third-party payment providers may collect payment information and financial details from you, which they process on our behalf. For instance, we use a service offered by Shopify Inc. (“Shopify”) to help you checkout and process your payments. Shopify may require you to register an account and may permit you to leave reviews about our product. Your use of Shopify’s products and services and any content or other information that you provide to Shopify will be governed by Shopify’s terms of service and privacy policy.

Tracking Technologies

When you use the Services, we may also collect certain information by automated means, such as cookies and web beacons. A “cookie” is a text file that websites send to a visitor’s computer or other Internet-connected device to uniquely identify the visitor’s browser or to store information or settings in the browser. A “web beacon,” also known as an Internet tag, pixel tag, or clear GIF, is used to transmit information about actions of a user. The information we may collect by automated means may include, without limitation:

  • Information about the devices you use to access the Services (such as the IP address and the type of the device, operating system, and web browser);
  • Dates, times, and duration of use of the Services; and
  • Information on actions taken when using the Services (such as page views and website navigation patterns).

This information helps us to improve and personalize our Services. To the extent that the automatically-collected information we obtain includes personal information, we will treat it in accordance with this Privacy Policy.

We also use third-party service providers to provide the Services and to manage analytics and behavioral advertising. These service providers may use their own cookies, web beacons, and related tracking technologies to provide their services, both on the Services and elsewhere on the Internet. These service providers include Google Ads and Analytics.

How Popchips Uses Your Personally Identifiable Information

Popchips may use your information to:  (A) provide access to the Service to communicate with you; (B) personalize, customize, measure, and improve the Service; (C) prevent, detect, and investigate potentially prohibited or illegal activities or a breach of the applicable agreement(s) between you and Popchips; (D) analyze the accuracy, effectiveness, usability, or popularity of the Service; (E) generate and review reports and data about Popchips’ user base and service usage patterns; (F) compile aggregate, anonymized data for internal business purposes; and (G) resolve disputes and troubleshoot problems.

Categories of Third-Party Persons or Entities With Whom Popchips May Share Your Personally Identifiable Information

We may disclose aggregated information about our users, and information that does not identify any individual user, without restriction. We may disclose personal information about you:

  • To contractors, service providers, and other third parties we use to support our Services (e.g., to process payments and to fulfill orders);
  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request or requirements;
  • To enforce or apply our Terms of Service (www.popchips.com/terms-of-service) and other agreements;
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Popchips, users of the Services, or others; and
  • With your consent.

We also reserve the right to transfer your personal information to a buyer or other transferee in the event of a merger, divestiture, restructuring, reorganization, dissolution, sale, or other transfer of some or all of our assets.  Should such a sale, merger, or transfer occur, we will use reasonable efforts to direct the transferee to use your personal information in a manner that is consistent with our Privacy Policy.  

Do Not Track

You may be able to adjust your browser settings or other settings so that “do not track” requests are sent to the Service’s websites and mobile applications. Popchips will not disable tracking technology that may be active on the Service in response to any “do not track” requests that are sent to the Service.

Your Choices 

We offer you the following choices about the information we collect from you and how we communicate with you:

Cookies

Most browsers will tell you how to stop accepting new cookies, how to be notified when you receive a new cookie, and how to disable existing cookies. Please note, however, that without cookies you may not be able to take full advantage of all of the features of the Services. Additionally, as noted above, some of our third-party service providers may provide ways to opt out of their services.

Promotional Communications 

If you have received a promotional email from us, you can opt out of receiving future promotional emails from us by following the unsubscribe instructions contained in such email.

Text/SMS Message Consent and Opt-out

If you choose, you can provide your mobile telephone number to receive text message alerts from our stores or sites to receive product information or promotions. You agree that, by providing your mobile telephone number, you expressly consent to receive automated marketing text messages from us to the mobile telephone number provided. Consent is not required to purchase product. Message and data rates will apply, and you should check the rates of your mobile carrier. You can opt out from further text marketing communications by texting STOP to the SMS number used to contact you.

We may share your mobile telephone number with service providers with whom we contract to assist us with the above activities. Text Messages are distributed via third-party mobile network providers and, therefore, we cannot control certain factors relating to message delivery. Depending on your mobile carrier, it may not be possible to transmit the text message to you successfully, and content is not available on all carriers. We do not claim or guarantee availability or performance of this service, including liability for transmission delays or message failures. 

Security

Popchips takes reasonable measures to protect the information you provide to Popchips or submit through the Service against loss, theft, unauthorized use, disclosure, or modification. However, Popchips cannot guarantee or warrant the security of any information you transmit to Popchips or submit through the Service and you do so at your own risk.

Transfers to the United States 

Popchips is based in the State of California in the United States. When we obtain information about you, we may transfer, process, and store such information outside of the country in which you reside, including in the United States. By using the Services, you consent to the transfer to and processing and storage of your information in countries outside of your country of residence, which may have different data protection laws than those in the country where you reside. 

Children's and Minor's Privacy 

The Services are not directed to, and Popchips does not knowingly collect or solicit personal information from, children under the age of 18. If we learn we have collected or received personal information from a child under the age of 18, we will delete that information. If you believe we might have any information from or about a child under the age of 18, please contact us at snackers@popchips.com.

Accessing, Changing and Managing Your Information.

Changing or Updating Your Information. You may send us an email at at snackers@popchips.com to request access to, correct, or delete any personal information that you have provided to us. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Retention of Your Information. We retain information about you for as long as it is necessary and relevant for Popchips’ operations and in accordance with applicable law. Popchips may retain information collected from you to comply with the law, prevent fraud, resolve disputes, troubleshoot problems, assist with any investigation, and take other actions permitted by law or disclosed in this Privacy Policy.

Notice of Privacy Rights to California Residents: Section 1798.83 of the California Civil Code permits California residents to request from a business, with whom the California resident has an established business relationship, information related to the personal information disclosed by Popchips to third parties for direct marketing purposes and the names and addresses of the third parties with whom the business has shared such information during the immediately preceding calendar year.
